BOOKING CONDITIONS
Tour Organization
The tours in this brochure are organized and operated by Tierno Tours LLC ( 1721 Lark Ln Cherry Hill NJ 08003 ). This catalog represents the entire agreement between the passenger and the above- mentioned Tierno Tours LLC. The terms, conditions, and limitation of liability under which the tours operate are detailed hereunder and the payment of security deposit or tour price represents acceptance by the purchaser of the following.
Client/Operator Agreement
Every effort made to ensure brochure accuracy at the time of going to press: however Tierno Tours LLC cannot be held responsible for printing or typographical errors, or arising from unforeseen circumstances. The agreement arising between the passenger and Tierno Tours LLC under this brochure and the booking made by the passenger shall be governed by the laws of the state of New Jersey , which shall have exclusive jurisdiction in the case of any dispute between parties. In the case of a computer or human billing error we reserve the right to re-invoice participants with correct billing. The invalidity of any the provisions hereof shall not affect the validity of any of the other provisions, and the agreement shall be construed as though such invalid provision had never been contained herein.
Responsibility
Tours are arranged and operated by Tierno Tours LLC, which acts only as an agent in matters pertaining to hotel accommodations, transportation, sightseeing, and all other tour arrangements as advertise. As such, Tierno Tours LLC assumes no responsibility for departures or arrivals, loss damage, or injury to person or property, mechanical defect, or failure of any nature, howsoever caused or arising, for the substitution of hotels or suppliers, with or without notice and for any additional expenses occasioned thereby. Tierno Tours LLC shall have no liability or incur any responsibility as a common carrier. Tierno Tours LLC shall be responsible to the passenger for supplying the services and accommodations described in this catalog. except where such services cannot be supplied or the itinerary used is changed due to delay or other causes of whatever kind or nature beyond the control of Tierno Tours LLC In such circumstances, Tierno Tours LLC will do their best to supply comparable services, accommodations and itineraries and there shall be no refund in this connection. Tierno Tours LLC reserves the right to decline to accept any person as a member of any tour at any time, and to cancel or alter the tour as may be required for operational reasons.
Tierno Tours LLC accepts no responsibility to reimburse any passenger who may be removed from a tour for any reason. Tierno Tours LLC reserves the right to correct and/or clarify any errors due to typography, editing, photography, or pricing. While Tierno Tours LLC will take all reasonable steps to provide an enjoyable tour, Tierno Tours LLC accepts no liability for any loss of enjoyment whatsoever and howsoever experienced by the client.
Land-Only Tour Inclusions
Land-only tour packages includes all transportation by exclusive, air-conditioned motorcoach (unless specifically indicated); hotel accommodations with private bathroom; all meals as listed; admissions and taxes on rooms and selected sight-seeing; tipping for handling of one piece of luggage per person.
Deposits & Final Payment
A person deposit of $400.US must be received to hold space permanently. Final payment must be to Tierno Tours LLC seventy days prior to the group air departure.
Fees
Tierno Tours LLC reserves the right to vary the price advertised or printed to cover any significant increase in fuel price, foreign exchange currency valuations, government taxes and charges, or other tour related tariffs and coats. Travelers are reminded that this is a condition of travel.
Tour Cancellations
Where a tour is cancelled, prior to the departure date, according to the aforementioned scenario, Tierno Tours LLC shall endeavor to offer the nearest possible alternative tour (subject to a refund or payment to cover any tour price difference) or, if this is not acceptable, refund your monies in full. Factors outside the control of Tierno Tours LLC may include weather, water levels, terrorism, acts of government, acts of God, provision of services by suppliers may lead to a reschedule or cancellation of tour.
Client Cancellation, Changes, Refunds
Notice of cancellation must be in writing to Tierno Tours LLC In this event of a client canceling, these fees apply whether or not a person is rebooked on anther tour;
Up to 91 days prior to departure – fully refundable
90 to 70 days prior to departure -$400. per person
69 to 45 days prior to departure – 50% of total plus any supplier fees
Within 44 days of departure – 100% of the booking trip interruption insurance is highly recommended.
Where Tierno Tours LLC does not operate the tour, attractions, excursions, and/or optional tours which may be included in the tour itinerary or associated with the tour Tierno Tours LLC cannot be held responsible for any loss, damage, or injury occasioned to any person or property as a result of any such inclusion undertaken during the tour whatsoever or howsoever the same may be caused whether as a result of negligence or otherwise. These tour inclusions may include activities such as trekking, exploring, or skiing. The client unreservedly accepts that these activities involve varying degrees of risks.
Itinerary changes
Tierno Tours LLC reserves the right to alter or change the accommodation, carries, or vessels at any time for any reason. Tierno Tours LLC reserves the right to cancel or alter the itinerary and/or tour without notice as may be found necessary for any reason whatsoever including, but not limited tp road, weather, or traffic conditions, non-performance of suppliers, industrial action, operational conditions and requirements, water level problems/excessive winds/other hazards outside our control. All additional expenses incurred as a result of any delays, cancellations, or alterations will be the sole responsibility of the client.
Baggage
Baggage is entirely at “owner’s risk” during the tour. Clients are strongly cautioned against leaving articles on board carriers or the tour coach at any time. Due limited coach space only one bag per person is included in the price. Passengers may bring one carry-on bag per person, provided the bag is carried personally and does not exceed 45 inches. No responsibility is accepted for loss of bags or any of the passenger’s belongings.
Airport Transfers
Scheduled pick-up and drop-off stops will be made on the day of arrival and return. These airport transfers are only guaranteed for those passengers who have provide their flight itinerary no later than 70 days prior to departure. Overnight accommodations required to meet the tour due to flight schedule changes and/or flight connections is not included in the tour price and is at the client’s own expense.
Gratuities
Customary gratuities to the motorcoach driver, tour escort tour guide, and hotel staff are not included. these gratuities should be extended on a voluntary, individual basis.
